    We cannot afford an attorney with the amount of child support paid. My husband’s ex is wanting to cut his time to weekends only and he has had 50% for 2 1/2 years and just under that for the other 2 1/2 years. My husband petitioned to modify custody reflecting the actual access time and to modify the child support accordingly. His ex responded with an attorney and admitted the shared time but expressed concerns of stability in our home. We are wondering how this is going to go over in court and if the burden of proof lies with the ex since she made the allegation. My husband is very involved with his daughter but his daughter does seem enmeshed with the mother. Also, do we need to petition a cross motion stating her allegation to be untrue before the return hearing? Thanks for any input. I realize you are not an attorney.
