South Carolina Child Custody Factors
- Court may issue orders touching the care, custody and maintenance of the children of the marriage and what, if any, security shall be given for the same as from the circumstances of the parties and the nature of the case and the best spiritual as well as other interests of the children may be fit, equitable and just.
- In placing the child in the custody of an individual or a private agency or institution, the court shall, whenever practicable, select a person or an agency or institution governed by persons of the same religious faith as that of the parents of such child, or, in case of a difference in the religious faith of the parents, then of the religious faith of the child, or, if the religious faith of the child is not ascertainable, then of the faith of either of the parents.

Can my friends ex lower his child support? She is marrying a wealthy doctor and her ex does not make alot of money. Can he modify the child support order, based on the fact she now pays no monthly living expenses and has access to alot of money? South Carolina. Thanks!

My husband and I have been trying to see his 4yr daughter for 8 months. He was never married to his daughter’s mother but they lived together from 2002-2005. The mother left him in Dec 2005 for a married man(live in boyfriend) and took his daughter to North Carolina from 2006-Dec for 2007. They moved in Dec 2007 to Missouri and are still living there as of Apr 2008. The live in boyfriend just got a divorce in Feb 2008. The mother just had his baby March 23,2008 and now they are planning on moving again from Missouri to Alabama. My husband has been in contact with the mother ever since she left in Dec 2005. The live in boyfriend has not allowed him to see his daughter. Everytime he calls the mother he threatens to put a restraining order on my husband and tells my husband to forget that she is his father. The mother was sending text messages to my husband of his daughter until Sept 2007. I am not sure what we should do or where we should get a lawyer. We just set up child support payments in Missouri. We even has supporting documents of his involvement with his daughter. Also my husband’s name is on his daughters birth certificate. Please help or give us some advice. Thank You.

Your situation is not hopeless. You and your husband have a lot going for you (including having each other.)
What’s very important to know is did your husband have any type of court-ordered visitation?
If he did, then his ex is obviously in contempt for violating it.
If he didn’t, then he needs to go to court and get an order.

I have a male friend who has a live in girlfriend who may or may not be pregnate with his child she is almost 6 months along…she is using drugs and has already lost 3 of her children to dss…he feels he has no rights unless he stays with her because they are not married…what should he do?
